The head of the U.S. Securities and Exchange Commission is facing growing questions over why the agency has paused its enforcement case against crypto entrepreneur Justin Sun.
During a recent congressional hearing, SEC Chair Paul Atkins defended the agency’s handling of the matter, saying legal restrictions prevent him from publicly discussing active litigation. Still, lawmakers pressed for answers as the case — first filed in 2023 — remains on hold nearly a year after proceedings were formally paused.
The original case against Sun
The SEC initially sued Sun in 2023, alleging that he conducted unregistered securities offerings and engaged in manipulative trading practices tied to the TRX token.
According to the complaint, Sun and related entities allegedly executed more than 600,000 wash trades to artificially inflate trading volumes of TRX. In February 2025, both the SEC and Sun’s legal team jointly requested a stay in the case, effectively freezing enforcement activity.
That pause has now stretched for roughly 11 months.
Lawmakers question political influence
At the hearing, Representative Maxine Waters, the ranking Democrat on the House Financial Services Committee, questioned whether political considerations played a role in the SEC’s decision to halt the case.
Waters pointed to reports suggesting Sun developed ties within President Donald Trump’s political network through World Liberty Financial Inc. She asked whether those relationships influenced enforcement decisions.
Atkins declined to address case specifics, reiterating that legal rules restrict public discussion of active or paused litigation. He said he would provide lawmakers with a confidential briefing “to the extent the rules allow.”
The scrutiny comes amid broader political debate surrounding crypto policy and potential conflicts of interest tied to Trump-linked crypto ventures.
Broader enforcement shift at the SEC
The pause in the Sun case is not happening in isolation.
Over the past year, the SEC has withdrawn, reduced, or settled several high-profile crypto enforcement actions involving major industry players such as Coinbase, Binance, Ripple Labs, Kraken, and Robinhood.
SEC leadership has described this change as a pivot away from “regulation by enforcement” toward clearer rulemaking and formal statutory guidance.
Atkins told lawmakers that the SEC is coordinating with the Commodity Futures Trading Commission as Congress considers legislative reforms, including the proposed CLARITY Act. The goal, he said, is to establish clearer boundaries around digital asset classification and oversight.
Political and regulatory tensions
Democratic lawmakers have linked the enforcement slowdown to President Trump’s growing involvement in the crypto industry. Reports estimate that Trump has generated significant revenue from cryptocurrency ventures, while the Trump family is said to hold stakes in digital asset and mining operations.
In January 2026, Representatives Waters, Ritchie Torres, and Stephen Lynch formally requested explanations for the pause or withdrawal of more than a dozen crypto-related cases.
For now, the SEC maintains that its actions are grounded in legal procedure and strategic regulatory reform rather than political pressure.
