Australia’s cryptocurrency industry received a major regulatory update this week after the country’s highest court ruled in favor of the Australian Securities and Investments Commission (ASIC) in its long-running legal battle with Block Earner.
The unanimous decision marks an important moment for crypto businesses operating in Australia, reinforcing that existing financial laws can apply to digital asset products even when those products are built on new technologies.
High Court Delivers Unanimous Verdict
On June 17, Australia’s High Court ruled 7-0 in favor of ASIC, concluding that Block Earner’s former fixed-yield crypto product required a financial services licence under Australian law.
The court found that the product, offered by Web3 Ventures Pty Ltd under the Block Earner brand, functioned as a financial investment facility. Judges also determined that it met the legal definition of a derivative because investor returns depended on movements in cryptocurrency prices and foreign exchange rates.
As a result, the court overturned an earlier ruling that had favored Block Earner and sent the matter back to the Full Federal Court for further consideration regarding potential penalties.
A Legal Battle Years in the Making
The dispute began in November 2022 when ASIC launched civil proceedings against Block Earner.
The regulator argued that the company had offered its “Earner” product without holding the required Australian Financial Services Licence. ASIC maintained that investors using the platform were not receiving the regulatory protections normally available under Australia’s financial services framework.
In February 2024, the Federal Court initially ruled that Block Earner had operated an unregistered managed investment scheme.
However, the court later decided not to impose financial penalties. ASIC challenged that outcome, while Block Earner filed its own cross-appeal.
In April 2025, the Full Federal Court sided with Block Earner, dismissing ASIC’s challenge. That decision has now been overturned by the High Court, bringing the case back into ASIC’s favor.

The company is currently working on crypto-backed home loans that would allow customers to use Bitcoin as collateral without selling their holdings.
This strategy reflects a broader industry trend toward integrating digital assets with traditional financial services rather than operating entirely outside established regulatory systems.
