The U.S. Office of the Comptroller of the Currency (OCC) has officially cleared national banks to intermediate cryptocurrency transactions using a riskless principal trading model, marking a notable shift in how traditional financial institutions can interact with digital assets.
Published on Dec. 9 as Interpretive Letter 1188, the guidance allows banks to temporarily purchase digital assets from one customer and immediately sell them to another in fully offsetting trades a structure that avoids market exposure and inventory risk.
What the OCC is allowing and why
Under this riskless principal framework, banks act as intermediaries rather than speculative participants. The OCC said the practice is similar to existing brokerage activities in traditional finance and falls under already permitted intermediation rules.
The core argument: regulation should be based on risk, not technology.
Because banks do not hold crypto positions for extended periods, the OCC categorized the activity as low risk, provided institutions maintain strong controls and customer protections.
Banks offering these services must demonstrate:
