The Attorney General of the District of Columbia has filed a lawsuit against Athena Bitcoin, accusing the crypto ATM operator of knowingly enabling scams that drained millions from elderly residents. Investigators allege that nearly every deposit made through Athena’s machines was tied to fraud, while the company quietly pocketed hidden fees as high as 26%.
Nearly All Deposits Linked to Scams
According to the lawsuit, 93% of Athena’s deposits were scam-related. The company, investigators say, ignored its own data showing that its kiosks were a magnet for fraudsters, particularly those targeting seniors.
With seven Bitcoin ATMs in the District, Athena allegedly created what officials called an “unchecked opportunity for illicit international fraud,” giving criminals a convenient way to funnel cash into irreversible crypto transactions.
Victims were overwhelmingly elderly, with a median age of 71. The average loss per transaction was $8,000 a devastating hit for seniors on fixed incomes. One victim, according to the complaint, lost $98,000 in just 19 transactions over a matter of days.
“These machines have become a tool for criminals intent on exploiting elderly and vulnerable District residents,” said Attorney General Brian Schwalb. “Athena knows that its machines are being used primarily by scammers yet chooses to look the other way so it can continue to pocket massive hidden fees.”
Hidden Fees and No Refunds
The AG’s lawsuit claims Athena not only ignored red flags but profited from the fraud:
- Excessive fees: While crypto exchanges typically charge 0.24%–3%, Athena’s machines allegedly charged up to 26% per transaction.
- Lack of transparency: These fees were buried in the fine print under vague terms like “Transaction Service Margin,” making them nearly impossible for customers many of them under scam pressure to understand.
- No refunds: Even when fraud was confirmed, Athena reportedly refused to return the money. Victims were allegedly forced to sign liability waivers that absolved the company of responsibility.
Legal Action and Consumer Protection
The lawsuit accuses Athena of violating the Consumer Protection Procedures Act and the Abuse, Neglect, and Financial Exploitation of Vulnerable Adults and the Elderly Act.
The AG’s office says the goal of the lawsuit is twofold: to recover stolen money for victims and to stop Athena’s predatory practices before more residents are harmed.

The case underscores the growing concern over crypto ATMs, which regulators warn are increasingly being exploited by scammers to prey on vulnerable populations. While marketed as convenient on-ramps to digital assets, these machines can also serve as gateways for fraud particularly when oversight is weak and protections are lacking.
