Grayscale’s two flagship Ethereum funds have entered a new regulatory phase, as the U.S. Securities and Exchange Commission (SEC) approved a request to move them under a more streamlined set of rules. The change signals a step forward in the maturity of crypto ETFs in U.S. markets.
From Non-Generic to Generic Standards
On September 23, the SEC confirmed that NYSE Arca’s Grayscale Ethereum Trust ETF and Ethereum Mini Trust ETF would transition from a “non-generic” to a “generic” listing standard.
Originally, these ETFs operated under bespoke rules that required ongoing, case-by-case SEC approvals. By adopting the generic framework, which is already used for commodity-based trust products, the funds can now continue trading with far less red tape.
The SEC fast-tracked the approval, waiving the usual 30-day waiting period, allowing the rule change to take effect immediately.
Why the Change Matters
NYSE Arca argued that the move aligns with Section 6(b)(5) of the Exchange Act, which requires exchange rules to protect investors, prevent manipulation, and promote fair trading. The exchange said the generic framework would “remove impediments to and perfect the mechanism of a free and open market.”
In simple terms, it eliminates unnecessary oversight for products that are already approved, creating smoother operations, more competition, and a more efficient market for investors.
While the SEC agreed, it did leave a safeguard in place: for the next 60 days, the agency retains the right to temporarily suspend the rule change if it deems it necessary to protect investors or market integrity.
Industry Reactions
Analysts see the development as another step toward broader crypto ETF adoption. Bloomberg Intelligence’s James Seyffart noted that the streamlined approach could help pave the way for spot crypto ETFs, including altcoin-focused products that have long awaited regulatory clarity.
The SEC also opened the door for public comments, allowing industry participants and investors to weigh in on whether the shift is consistent with the Exchange Act.
Bigger Picture
The change highlights how crypto investment products are beginning to fall under the same frameworks used for more traditional commodity funds. For Grayscale, it reduces regulatory friction and signals that Ethereum-based ETFs are entering a more mature phase of market integration.
