Texas has taken a significant step in regulating digital assets with the passage of Senate Bill 1498 (SB1498) a new law that grants law enforcement the authority to seize cryptocurrencies and other digital assets linked to criminal activity. The bipartisan bill was approved by lawmakers on June 20 and is slated to go into effect on September 1, 2025.
Digital Assets Now Subject to Civil Asset Forfeiture
Under SB1498, Texas law enforcement agencies can seize cryptocurrencies, stablecoins, NFTs, and other digital assets if they are found to be used in or derived from illegal activities such as:
- Drug trafficking
- Fraud and theft
- Organized crime
- Human trafficking
The bill also allows the state to claim any increase in value of the seized digital assets from the time they were obtained to the time they are forfeited.
Much like existing rules for cash, vehicles, and property tied to crimes, SB1498 brings digital property under Texas’ civil asset forfeiture framework. Once seized, digital assets must be moved into secure, offline wallets controlled exclusively by the law enforcement agency or state attorney involved. Any forfeiture proceedings must be filed in the county where the seizing agency is based.
“This legislation closes major gaps in our criminal justice system and brings digital property under proper legal scrutiny,” lawmakers stated in support of the bill.
Texas Leads with Bitcoin Reserve Initiative
SB1498 comes just days before another landmark development: On June 22, Governor Greg Abbott signed Senate Bill 21 (SB21) into law, making Texas the first U.S. state to create a publicly managed Bitcoin reserve.
This law establishes a dedicated Bitcoin fund held separately from the state’s general treasury, intended to serve as a hedge against inflation and bolster financial resilience. With this, Texas joins Arizona and New Hampshire as one of the few states legally allocating public funds into Bitcoin.
A Broader Trend in Crypto Law Enforcement
SB1498 also reflects a growing national trend. Arizona is currently updating its own forfeiture laws to explicitly include digital assets, signaling broader regulatory alignment across U.S. states.
As digital assets become increasingly embedded in criminal enterprises and financial systems, states are racing to modernize their laws to ensure enforcement agencies can act effectively. Texas lawmakers emphasized that the rapid rise of cryptocurrency use in fraud, scams, and laundering made SB1498 a timely and necessary legislative update.
What This Means for Crypto in Texas
With the passage of SB1498 and SB21, Texas cements its position as both a leader in crypto adoption and regulation. While one law empowers the state to crack down on illicit use of digital assets, the other showcases an unprecedented move to integrate Bitcoin into public finance.
