Poland has become the only European Union member state without a fully functioning domestic framework for the Markets in Crypto-Assets Regulation (MiCA) after lawmakers failed for the third time to override a presidential veto on crypto legislation.
The failed vote has left thousands of crypto companies operating in uncertainty, forcing businesses to seek regulatory approval in other EU countries or risk losing access to the European market.
The Polish parliament needed a three-fifths majority to overturn President Karol Nawrocki’s veto but fell short, extending a political deadlock that has delayed crypto regulation for months.
Poland Fails Third Attempt to Pass Crypto Framework
On Sept. 4, 2026, Poland’s lower house, the Sejm, attempted another vote to override the president’s rejection of the crypto market bill.
The result was:
- 241 lawmakers voted in favor
- 198 voted against
- 3 abstained
However, the required threshold was 266 votes, meaning the proposal failed once again.
The legislation was designed to bring Poland’s crypto industry in line with MiCA, the EU-wide regulatory framework governing digital asset service providers.
The law would have granted the Polish Financial Supervision Authority (KNF) the power to issue licenses, supervise crypto companies, and enforce compliance standards.
MiCA Deadline Leaves Polish Firms in Regulatory Limbo
The situation became more serious after the MiCA transitional period ended on July 1, 2026.
Under the new rules, crypto-asset service providers operating in the European Union must hold authorization from their domestic regulator or another EU regulator.
However, Poland’s KNF cannot issue MiCA licenses because lawmakers have not passed legislation giving it the necessary authority.
As a result, around 2,000 Polish crypto firms are now facing a regulatory gap.
Many companies are now considering relocation options, including applying for licenses in countries such as Lithuania, Latvia, and Germany.
What Poland’s Crypto Bill Would Have Changed
The proposed Act on Crypto-Asset Markets was designed around three main areas:
1. Licensing Requirements
Crypto businesses operating in Poland would have needed authorization from the KNF.
This would apply to:
- Cryptocurrency exchanges
- Custody providers
- Portfolio management services
- Digital asset transfer providers
- Crypto advisory platforms
Token issuers would also face disclosure and registration obligations.
2. Enforcement Powers
The bill would have expanded KNF’s supervisory authority.
The regulator would have gained the ability to:
- Suspend transactions temporarily
- Fine companies and token issuers
- Block websites linked to illegal or fraudulent crypto operations
The website-blocking authority became one of the most controversial parts of the proposal.
3. Consumer Protection Rules
The legislation included:
- Mandatory disclosures for token issuers
- Marketing restrictions
- Criminal penalties for certain violations involving customer assets
Supporters argue these measures were standard across Europe, noting that countries such as Germany, France, Malta, and Cyprus had already implemented similar MiCA-aligned frameworks.
President Nawrocki’s Opposition to the Crypto Law
President Nawrocki has rejected multiple versions of the legislation, arguing that the proposed rules create excessive costs and restrictions for smaller crypto businesses.
His main concerns include:
- High compliance costs
- Supervisory fees
- Broad KNF enforcement powers
- Potential damage to Poland’s technology sector
The president has specifically criticized the ability to block websites connected to unlicensed crypto activity, arguing that such powers could negatively affect legitimate companies.
He has also warned that strict regulation could push Polish crypto businesses to move operations abroad.
Nawrocki has proposed an alternative approach focused more narrowly on preventing fraud rather than creating a full licensing framework.
Zondacrypto Collapse Adds Pressure for Regulation
The regulatory debate is happening alongside one of Poland’s largest crypto scandals.
The collapse of Zondacrypto, previously known as BitBay and one of Central Europe’s largest exchanges, has intensified calls for stronger oversight.
Investigators initially focused on allegations involving around 350 million zlotys in losses, while later estimates suggested exposure could reach approximately 2.4 billion zlotys.
The exchange’s Estonian operating company, BB Trade Estonia, was declared bankrupt in August 2026, with creditors scheduled to meet in September.
The scandal has created competing arguments:
- Government supporters say it proves stronger regulation is urgently needed.
- Critics argue the proposed law would not necessarily have prevented fraud.
Polish Crypto Companies Look Abroad
With no domestic MiCA framework, many Polish crypto companies are exploring licenses in other EU countries.
The most popular destinations include:
- Lithuania
- Latvia
- Germany
These jurisdictions allow companies to obtain authorization and then provide services across the entire European Union through passporting rules.
However, relocation is expensive and time-consuming.
Companies may need to:
- Establish foreign subsidiaries
- Hire local compliance teams
- Pay additional licensing costs
- Move parts of their operations abroad
Smaller firms may not have enough resources to complete this process, potentially leading some businesses to shut down.
Poland Falls Behind Other EU Crypto Markets
While Poland remains stuck in political disagreement, other European countries have moved ahead with MiCA implementation.
Germany has become one of the leading crypto markets in the EU, with dozens of authorized crypto-asset service providers operating under the framework.
France, the Netherlands, Malta, and Cyprus have also established regulatory systems allowing crypto companies to operate legally under MiCA rules.
The contrast highlights that Poland’s challenge is not technical but political.
Economic Impact of Regulatory Delay
Poland has one of the most active crypto communities in Europe.
A significant portion of the population has interacted with digital assets, creating demand for exchanges, fintech companies, and blockchain services.
However, the absence of clear regulation risks pushing companies, jobs, and investment toward neighboring countries.
Crypto entrepreneurs may continue moving operations to jurisdictions where licensing rules are already established.
What Happens Next for Poland’s Crypto Regulation?
Several developments could determine the future of Poland’s crypto sector:
Another Legislative Attempt
The government may introduce a fourth version of the crypto bill, but it must either gain enough votes to overcome another veto or include changes acceptable to the president.
Crypto Business Relocations
The number of Polish companies applying for foreign MiCA licenses will show how damaging the regulatory uncertainty has become.
Zondacrypto Investigation
The upcoming creditor meeting could increase public pressure for stronger crypto oversight.
Possible EU Enforcement
Because Poland has not implemented the required framework, the European Commission could take action over MiCA compliance failures.
Poland’s crypto industry is now caught between political disagreement and regulatory deadlines.
The country’s failure to implement MiCA has created uncertainty for businesses, investors, and users at a time when the rest of Europe is moving toward clearer digital asset rules.
Whether Poland can quickly resolve the dispute will determine if it remains a major crypto market in Europe or loses companies and talent to countries with more predictable regulation.
