Brazil is taking another major step toward regulating its cryptocurrency industry.
The country’s Central Bank has approved a new set of prudential rules that will require cryptocurrency exchanges and other virtual asset service providers (VASPs) to meet stricter standards for capital reserves, risk management, and financial disclosures.
The new framework, which comes into effect on January 1, 2027, is part of Brazil’s broader effort to align crypto regulation with the standards applied to traditional financial institutions while strengthening investor protection.
New capital and risk management rules approved
Under the new regulations, companies offering cryptocurrency-related services—including trading, custody, and digital asset transfers—will be required to maintain minimum capital reserves and implement formal risk management frameworks.
They will also have to provide regular disclosures about their financial condition and operational activities.
According to Brazil’s Central Bank, the goal is to improve the stability of the country’s financial system while reducing risks for both investors and the broader cryptocurrency market.
The regulator emphasized that businesses performing activities with similar financial risks should be supervised under similar regulatory standards, regardless of whether they operate in traditional finance or the crypto sector.
Crypto firms will move into Brazil’s banking supervision framework
The new rules also introduce a gradual transition into Brazil’s banking supervisory structure.
By June 30, 2028, all licensed virtual asset service providers will be classified under Segment 4 (S4) of the country’s financial supervision framework.
This transition period gives crypto companies additional time to comply with the full prudential requirements before becoming subject to the same level of oversight as other regulated financial institutions.
Meanwhile, smaller institutions operating under Segment 5 (S5)—a simplified regulatory category designed for low-risk financial firms—will no longer be permitted to offer cryptocurrency services.
The Central Bank concluded that virtual asset activities carry risks that exceed the lighter supervisory standards applied to S5 institutions.
Part of Brazil’s broader crypto regulatory strategy
The latest announcement builds on several regulatory initiatives introduced over the past year.
In November 2025, Brazil published its first comprehensive operating framework for virtual asset service providers. Those rules established standards covering:
- Corporate governance
- Anti-money laundering (AML) compliance
- Operational controls
- Participation in foreign exchange markets
Earlier this year, Brazil’s National Monetary Council also required crypto companies to follow confidentiality standards similar to those imposed on banks under the country’s financial secrecy laws.
These measures are intended to strengthen trust in the digital asset sector while bringing it closer to traditional financial regulation.
Independent audits now required
Brazil has also tightened licensing requirements for cryptocurrency businesses.
A regulation introduced in June requires companies seeking new licenses—or renewing existing ones—to submit independent audit reports prepared by professionals registered with Brazil’s securities regulator.
The audits evaluate several key areas, including:
- Anti-money laundering controls
- Counter-terrorism financing procedures
- Customer asset segregation
- Internal risk management systems
- Employee compliance programs
Only companies that satisfy these requirements will be eligible for regulatory approval.
Authorities continue expanding oversight
Brazilian regulators have expanded crypto supervision beyond exchange operations.
In May, the Central Bank prohibited regulated cross-border foreign exchange providers from using cryptocurrencies to settle international payment transactions, although digital assets remain legal for trading and transfers outside the supervised payment system.
More recently, federal prosecutors reminded political parties that cryptocurrency donations remain prohibited during election campaigns because campaign finance laws require every donor to be clearly identified.
These developments reflect Brazil’s increasingly comprehensive approach to digital asset regulation.
A more mature regulatory environment
Brazil has emerged as one of Latin America’s most active cryptocurrency markets, and regulators are gradually introducing rules that balance innovation with financial stability.
Rather than restricting the industry outright, authorities are focusing on building a regulatory framework that mirrors traditional financial markets through stronger governance, transparency, capital requirements, and consumer protection.
For crypto exchanges operating in Brazil, the latest prudential rules represent another important step toward a more structured and regulated industry.
