The ruling marks the <strong>first criminal sentencing for unregistered crypto activity in the U.K.<\/strong> and signals a growing crackdown on illicit digital asset services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Crypto ATM Business Operated Without FCA Registration<\/strong><\/h3>\n\n\n\n<p>Osunkoya, <strong>46<\/strong>, ran his crypto ATM business through his company, <strong>GidiPlus<\/strong>, installing <strong>machines at multiple locations across the U.K.<\/strong> Despite being <strong>denied registration<\/strong> by the <strong>Financial Conduct Authority (FCA)<\/strong>, he proceeded to set up a <strong>\u00a32.5 million ($3.2 million) business<\/strong>, charging transaction markup fees between <strong>30% and 60%<\/strong>.<\/p>\n\n\n\n<p>The FCA launched <strong>legal proceedings in September 2024<\/strong>, charging Osunkoya with <strong>six offenses<\/strong>. He pleaded <strong>guilty on September 30, 2024<\/strong>, and was convicted on <strong>February 28, 2025<\/strong>, on the following counts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Unregistered crypto activity<\/strong><\/li>\n\n\n\n<li><strong>Forgery<\/strong><\/li>\n\n\n\n<li><strong>Possession and use of false identity documents<\/strong><\/li>\n\n\n\n<li><strong>Criminal property possession<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Deliberate Defiance of Regulations<\/strong><\/h3>\n\n\n\n<p>During sentencing, <strong>His Honour Judge Perrins<\/strong> highlighted Osunkoya\u2019s <strong>intentional disregard for regulations<\/strong>, stating:<\/p>\n\n\n\n<p>\u201cYour decision to continue to operate illegally was an act of deliberate and calculated defiance to the regulator.\u201d<\/p>\n\n\n\n<p>The court also noted that Osunkoya <strong>went to great lengths to create a false identity<\/strong>, making his case <strong>more than just a regulatory violation<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>FCA\u2019s Crackdown on Illegal Crypto ATMs<\/strong><\/h3>\n\n\n\n<p>Osunkoya\u2019s sentencing reflects the <strong>FCA\u2019s intensified enforcement<\/strong> against unregistered crypto businesses.<\/p>\n\n\n\n<p>\u201cThis is the UK\u2019s first criminal sentencing for unregistered crypto activity and sends a clear message: those who flout our rules, seek to evade detection and engage in criminal activity will face serious consequences,\u201d said <strong>Therese Chambers<\/strong>, FCA\u2019s <strong>executive director of enforcement<\/strong>.<\/p>\n\n\n\n<p>The regulator mandates that <strong>all digital asset service providers<\/strong> comply with <strong>anti-money laundering (AML) regulations<\/strong> and secure <strong>FCA registration<\/strong>. As part of its enforcement, the FCA has aggressively shut down <strong>unregistered crypto ATMs<\/strong>, reducing their numbers in the U.K. from <strong>80 in 2022 to zero in 2024<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Global Crypto ATM Landscape<\/strong><\/h3>\n\n\n\n<p>While the U.K. has <strong>eliminated all crypto ATMs<\/strong>, data from <strong>CoinATMRadar<\/strong> shows there are currently over <strong>37,200 crypto ATMs<\/strong> operating in <strong>69 countries<\/strong>. The <strong>United States leads the market<\/strong>, hosting <strong>over 29,700<\/strong> of these machines.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h3>\n\n\n\n<p>Osunkoya\u2019s case underscores the <strong>risks of operating unregistered crypto businesses<\/strong> in the U.K. and the <strong>FCA\u2019s commitment to enforcing compliance<\/strong>.
