However, miners still face tax obligations, energy rules and, most importantly, state and local restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For commercial operators, the biggest obstacles are often not federal crypto laws at all. They are local zoning rules, noise limits, environmental permits and the time required to secure a utility connection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That creates an unusual regulatory environment: mining is broadly permitted across the United States, but whether a particular facility can actually operate depends heavily on where it is located.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is crypto mining legal in the US?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. Crypto mining is legal throughout the United States at the federal level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is currently:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No federal mining license<\/li>\n\n\n\n<li>No federal permit specifically for mining<\/li>\n\n\n\n<li>No federal prohibition on operating mining equipment<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Several federal agencies that could potentially regulate mining have also generally placed ordinary mining activity outside their core regulatory frameworks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more complicated rules begin when a mining business operates a physical facility, consumes large amounts of electricity or provides additional financial services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is where state regulators, utilities and local governments become much more important.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEC and CFTC treatment of crypto mining<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important regulatory developments came on <strong>March 17, 2026<\/strong>, when the SEC and CFTC issued a joint interpretation addressing several common crypto activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under that interpretation, ordinary proof-of-work mining is not treated as a securities transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mining rewards themselves are not considered securities simply because they were generated through mining, and operating mining hardware does not automatically create an investment contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provides considerably more clarity for miners than existed during earlier periods of crypto enforcement uncertainty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the distinction applies specifically to the act of mining.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Financial products built around mining can still raise securities-law questions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mining does not normally make someone a money transmitter<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinary miners also generally fall outside money-transmission regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A miner receiving cryptocurrency as a reward for providing computing power is not normally accepting and transmitting money on behalf of another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means the act of mining itself does not usually trigger money-services-business registration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The situation can change if the business provides additional services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, regulatory questions may arise if a mining operation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Holds customer funds<\/li>\n\n\n\n<li>Operates a pool that holds participant balances<\/li>\n\n\n\n<li>Converts assets for customers<\/li>\n\n\n\n<li>Provides custodial services<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pure mining and businesses built around mining therefore need to be treated differently.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Federal law still taxes crypto mining<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">While federal financial regulation largely leaves ordinary mining alone, tax law does not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mining rewards are generally treated as <strong>ordinary income when received<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fair market value of the cryptocurrency at the time the miner obtains control of it becomes taxable income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That same value then becomes the cost basis used to calculate any future gain or loss when the cryptocurrency is later sold or otherwise disposed of.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a miner receives Bitcoin worth $1,000 when the reward becomes available, that $1,000 is generally recognized as income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Bitcoin is later sold for $1,300, the additional $300 may create a capital gain.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Hobby miners and mining businesses are treated differently<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The tax treatment also depends on whether the activity is considered a hobby or a business.<\/p>\n\n\n\n<p between a hobby and a business therefore has a meaningful effect on the miner&#8217;s overall tax position.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Record keeping is a major challenge<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the least glamorous but most important parts of mining compliance is record keeping.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each reward may create a separate taxable event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means miners need records showing:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The date the reward was prohibition on the activity itself.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">California introduced a broader crypto licensing regime<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">California&#8217;s <strong>Digital Financial Assets Law<\/strong> took effect on July 1, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law establishes licensing requirements for certain crypto businesses operating in the state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not specifically a mining law, but its broad coverage can affect mining-related companies depending on the services they provide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is especially relevant where an operator does more than simply run mining hardware and becomes involved in customer assets or other regulated class=\"wp-block-paragraph\">Arkansas previously adopted legislation intended to protect mining and data-center operators from discriminatory taxes and regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, local complaints have since contributed to debate over issues such as noise control and permitting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tennessee has also taken a supportive approach by allowing home mining and permitting certain mining facilities in industrial zones.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Most states have no specific mining law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the attention given to states such as Texas and New York, most US states do not have dedicated crypto mining legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, mining facilities operate under the same general rules that apply to other large industrial or data-center projects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means the real decision-makers may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Local governments<\/li>\n\n\n\n<li>County zoning boards<\/li>\n\n\n\n<li>Electric
