tied to foreign crypto ETFs would remain unavailable during the first phase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, depositary receipts referencing overseas crypto ETFs would not initially be permitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means locally established and exchange-listed crypto ETFs would remain the primary regulated structure for Thai investors seeking this type of exposure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Domestic Custodians Remain the Preferred Option<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Custody was one of the most closely watched issues during the SEC&#8217;s earlier consultation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the revised framework, locally licensed digital asset custodians would remain the protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The framework would additionally allow qualified digital asset custodians and other properly prepared digital asset businesses to act as trustees for crypto ETFs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These providers would need adequate capital, experienced personnel, and operational systems and would be expected to maintain those standards throughout their involvement with the funds.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Thailand Is Building More Domestic Crypto Custody Capacity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thailand has already been working to strengthen its local digital asset custody infrastructure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In May, the SEC proposed changes to net capital and custody requirements designed to encourage more customer assets and trading activity to remain with domestic providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The broader objective is to reduce dependence on foreign service providers while building stronger local infrastructure for regulated cryptocurrency investment products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keeping custody primarily within Thailand could also make regulatory oversight easier, although allowing qualified overseas providers gives fund managers additional flexibility if domestic capacity is insufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The balance between local custody and international providers is likely to remain important as Thailand&#8217;s institutional crypto market expands.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ETF Rules Follow Expansion of Crypto Derivatives<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thailand&#8217;s ETF framework is part of a wider effort to bring more cryptocurrency products into regulated financial markets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February, the government recognized cryptocurrencies as eligible underlying assets under the country&#8217;s Derivatives Trading Act.<\/p>\n\n\n\n<p investors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new regulatory proposal goes further by establishing rules for crypto ETFs created directly in Thailand and listed on the Stock Exchange of Thailand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That could significantly broaden access if the final regulations eventually allow retail participation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bitcoin and Ether Will Lead the First Phase<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The SEC plans to limit the first stage of the framework to Bitcoin and investor protection requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fund managers would need to provide clear disclosures explaining the structure of each ETF, cryptocurrency-specific risks, and how the underlying assets are managed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investor education would also be required to help buyers understand the risks associated with exposure to highly consultation on the crypto ETF proposal opened on Aug. 21, with the SEC formally announcing the draft framework on Aug. 24.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Market participants and members of the public can submit comments until Sept. 20.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the consultation closes, regulators can review the feedback and make additional changes before moving toward final rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If adopted, the framework would give Thailand a clearer structure for locally established Bitcoin and Ether ETFs and could
