In some cases, newly created accounts were also able to receive cryptocurrency deposits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The findings raise questions about how Binance is operating in Europe after the expiration of transitional arrangements under the Markets in Crypto-Assets regulation, better known as MiCA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance Still Onboarding Some European Users<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to a report shared with crypto.news, tests were conducted using connections from Austria, France, Germany, Spain and Belgium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The tests used both regular internet connections and virtual private networks. In several cases, users were able to proceed through Binance\u2019s onboarding process without receiving any notice that the exchange lacked MiCA authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two accounts were reportedly fully verified and allowed to receive cryptocurrency deposits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One account created on Aug. 19 used a European identity document and residential address. It successfully passed verification and was later funded with crypto, despite being created well after the July 1 deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly significant because Binance had previously informed users in several European countries that new registrations and certain deposit services would be restricted after the deadline.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance Remains Absent From the MiCA Register<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance is not currently listed among authorized crypto asset service providers on the register maintained by the European Securities and Markets Authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exchange had previously applied for MiCA authorization in Greece, but withdrew that application in June after the licensing process failed to progress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance has said it remains committed to the European market and is pursuing authorization through another EU member state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the company has not publicly identified the jurisdiction where its latest application is being processed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until approval is granted, Binance\u2019s regulatory position in Europe remains under scrutiny.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Some Restrictions Are Still Active<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although new account creation has not been completely blocked, the latest tests suggest Binance has implemented certain restrictions across Europe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, one user connecting through Austria with a Spanish identity document reportedly completed account verification within minutes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Crypto deposits remained available on the account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the user was unable to deposit euros through a bank transfer because a third-party payment provider flagged an address mismatch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another registration attempt made from Spain using local identity and employment information also progressed through most of the signup process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The account was ultimately rejected because the applicant already had an existing Binance account, rather than because of MiCA restrictions or EU residency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This suggests that Binance\u2019s onboarding controls may vary depending on the user, jurisdiction and type of service being accessed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">US Users Faced Much Stricter Restrictions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tests from the United States produced a very different result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A user connecting from the U.S. was immediately redirected to Binance.US, the separate American platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When accessing the international Binance platform, deposits and trading were suspended, with withdrawals remaining available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contrast demonstrates that Binance is capable of applying region-specific restrictions based on location.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes the continued availability of some account functions for European users particularly relevant to the MiCA discussion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance Says European Services Depend on Local Rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance has said it does not comment on individual users or specific account cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company explained that service availability across Europe can vary depending on the jurisdiction, transitional rules, the product involved and individual circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance also said it has taken steps to ensure that its European products and services comply with relevant regulatory frameworks following the implementation of MiCA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the exchange did not provide a detailed explanation for why users in some EU countries could still create and verify new accounts after July 1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance maintains that it is actively progressing toward MiCA authorization.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Belgian Account Was Connected to Binance Poland<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the more notable tests involved a Belgian user.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The account was created without using a VPN and reportedly became active within approximately ten minutes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The verification process included an identity card photograph, live facial verification and questions about employment, income and savings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Binance\u2019s terms, Belgian customers contract with Binance Poland Sp. z o.o., a Polish-registered virtual asset service provider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, Binance Poland does not appear among the MiCA-authorized entities referenced in the report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The account\u2019s payment services were reportedly handled by BPay Global, a Bahrain-based Binance affiliate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A potential euro transfer was set to settle through JSC Pave Bank in Tbilisi, Georgia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The transfer was not completed, so it remains unclear what additional checks would have applied before settlement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">MiCA Regulates Services, Not Just Website Access<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A key point in the controversy is that MiCA does not simply regulate whether users in the EU can visit an exchange website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The framework regulates the actual provision of crypto asset services to European customers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means the relevant questions include whether users can register, verify their identities, make deposits, trade and access other regulated services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For that reason, the tests focused on whether completely new European customers could successfully open accounts and fund them after the July 1 deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The results suggest that at least some users retained access to functions beyond simple website browsing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ESMA Told Unauthorized Firms to Stop New Onboarding<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before the deadline, ESMA issued clear instructions to firms that had not obtained authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a June 23 statement, the regulator said unauthorized providers should stop accepting new EU customers and limit remaining services to those necessary for existing clients to exit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ESMA also said unauthorized providers should have implemented their wind-down plans by July 1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">National regulators were instructed to review those plans and take action where crypto services were being provided without proper authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier guidance from ESMA also indicated that providing covered crypto services to EU customers without authorization could constitute a breach of EU law once the relevant transition period ended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes continued onboarding of new users a potentially important compliance issue.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">More Than 1,000 Providers Missed the Deadline<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance is not the only company affected by the new licensing regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A review conducted after the deadline found that only 281 of 1,343 crypto providers operating across the European Economic Area before the transition had obtained authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That left 1,062 firms without approval at that time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The number of authorized providers has gradually increased since then.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Around the July deadline, ESMA added dozens of firms to its register, including major financial institutions such as Standard Chartered and FalconX.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By Aug. 20, the register cited in the report contained approximately 330 authorized providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance was not among them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance Is Also Absent From ESMA\u2019s Unauthorized List<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Interestingly, Binance was also reportedly absent from ESMA\u2019s separate register of companies identified as providing crypto services without authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That list contained 167 entries as of Aug. 20.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most of those entries had been submitted by Italy\u2019s Consob, while regulators in the Netherlands and Slovakia had contributed additional names.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance\u2019s absence from both registers creates an unusual situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exchange does not currently appear among approved providers, but it also has not been publicly placed on the regulator\u2019s unauthorized-provider list referenced in the report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance Had Already Restricted Services in Europe<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance introduced several country-specific restrictions after failing to obtain authorization before the MiCA deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">French customers, for example, lost access to certain trading functions in early July.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spot and margin trading were among the affected services, while withdrawals continued to be available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance also told affected customers that their assets remained backed on a one-to-one basis and could still be withdrawn where permitted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earn products and other services were also expected to face restrictions in several markets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current situation therefore appears more complex than a complete shutdown of Binance\u2019s European operations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Different customers may be facing different service limitations depending on their country and account status.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Binance\u2019s Greek MiCA Application Failed to Progress<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance\u2019s regulatory problem emerged before the July deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exchange formally pursued MiCA authorization in Greece, while also holding discussions with regulators elsewhere in Europe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By late June, however, the Greek application had failed to move forward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Binance ultimately withdrew the application shortly before the Hellenic Capital Market Commission was reportedly expected to reject it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company then said it would pursue another pathway to authorization within the European Union.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because MiCA allows licensed companies to passport their services across member states, securing approval in one jurisdiction could eventually restore broader European operations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For now, however, Binance remains without publicly confirmed authorization.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Regulators Have Started Enforcing MiCA<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The regulatory environment is also becoming more active.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Austria\u2019s Financial Market Authority announced its first enforcement case under MiCA in August, imposing a \u20ac70,000 fine on Bitpanda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The regulator said the company failed to submit a required crypto asset whitepaper within the required timeframe and published marketing materials without the necessary regulatory disclaimer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case demonstrates that national authorities are beginning to apply the new framework in practice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That increases the importance of how major exchanges such as Binance handle customers while waiting for authorization.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens Next for Binance in Europe?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Binance\u2019s future in Europe will largely depend on whether it can secure MiCA approval through another member state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A successful application would give the exchange passporting rights, allowing it to provide approved services across much of the EU under a unified regulatory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Until that happens, however, the continued onboarding of some new European users could attract further attention from national regulators and ESMA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main question is whether Binance\u2019s current account access and deposit functions are consistent with applicable transitional arrangements or whether regulators consider them unauthorized crypto services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ESMA was reportedly asked to clarify the issue but had not provided a final public response at the time of reporting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For Binance, obtaining MiCA authorization remains critical.
